4. DECLARATION TO THE COMMISSION NATIONALE INFORMATIQUE ET LIBERTÉS
The automated processing of personal data has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL ) under number 1868410 v0, in accordance with article 22 of law no. 78-17 of January 6, 1978 relating to information technology, files and freedoms, as amended in 2004.
4. Violation of the GCU
It is strictly forbidden to use the Platform for any of the following purposes:
-
carrying out illegal, discriminatory or fraudulent actions, or actions infringing the rights or safety of third parties,
- undermining public order or violating applicable laws and regulations,
-
aiding or inciting, in any form and in any manner whatsoever, one or more of the acts described above,
-
and more generally any practice that misuses the Platform for purposes other than those for which it was designed.
5. Liability
Access to and browsing of the Platform are the sole responsibility of Users. Users are responsible for installing antivirus software and other security measures on their computer systems.
To the fullest extent permitted by applicable law, FLATCHR expressly excludes liability for any indirect damage resulting from or in connection with access to the Platform, its use, malfunction or unavailability, whatever the nature and duration thereof. The User acknowledges that FLATCHR remains free to correct and/or modify the Platform at any time and without notice, without such correction and/or modification giving rise to any right of recourse on the User's part.
In general, FLATCHR shall not be held liable in any case where the non-performance or improper performance of the GCU is the result of force majeure or an act of God beyond its control.
6. Intellectual Property
The Platform and each of its components, including texts, images, visuals, videos, sounds, logos, interfaces, and trademarks such as the "FLATCHR" trademark, are protected by intellectual property rights and are the exclusive property of FLATCHR.
The development of the Platform has involved significant investments and joint work by the FLATCHR teams, for this reason and unless expressly stipulated otherwise, FLATCHR does not grant Users any right other than a personal right to consult the Platform and on a non-exclusive basis and limited exclusively to browsing the site and, for Candidates, to applying for jobs on the career sites of Flatchr's recruiting clients.
It is strictly forbidden to represent, reproduce and/or exploit the Platform, and each of its components, in whole or in part, in any form and by any means whatsoever, without the prior written consent of FLATCHR. The User agrees not to copy, modify, assemble, decompile, alter, sell, rent, lend, broadcast, distribute or transfer all or part of the Platform, create derivative works from the Platform, or authorize a third party to commit such acts, without FLATCHR's prior written consent. Failure to comply with the provisions of this article constitutes an infringement of the intellectual property rights of FLATCHR and/or third-party licensors and may result in civil and criminal proceedings.
Any other reproduction and/or representation of all or part of the Platform must be subject to a prior request for authorization to FLATCHR at the following address:contact@flatchr.io.
7. Hypertext links to other websites
The Platform may contain links to external websites which may be of interest to the User. FLATCHR shall not be held responsible or liable for the content of any of these third-party websites to which the User may have had access via these links. Furthermore, FLATCHR has no means of controlling the content of these third-party websites, which remain totally independent of FLATCHR. In addition, the existence of a link between the Platform and a third-party website does not mean that FLATCHR approves in any way the content of this site and a fortiori the use that could be made of it.
8. Cookies
FLATCHR uses cookies for the proper operation of the Platform. For further information, the User is invited to consult the Confidentiality and Cookie Management Policy.
9. Duration
The general conditions of use applicable are those in force on the day of use of the Platform by the User. They are applicable for the entire duration of the User's use of and browsing on the Platform.
10. Applicable Law - Jurisdiction
These TOU are governed by French law. In the event of a dispute between the Parties, FLATCHR encourages the User to first contact FLATCHR teams in order to find an amicable solution. FLATCHR will consider reasonable requests for alternative dispute resolution procedures such as mediation, arbitration or collaborative law. In accordance with articles L. 612-1 et seq. of the French Consumer Code, the User may have recourse, free of charge, to a consumer mediator for the amicable resolution of any dispute with FLATCHR. Referral to the mediator must be made within a maximum period of one (1) year from the date of the written complaint sent by registered mail with acknowledgement of receipt to FLATCHR. Complaints may be submitted by post or directly on the mediator's website.
IN THE ABSENCE OF AN AGREEMENT BETWEEN THE PARTIES TO RESOLVE THE DISPUTE BY MEANS OF ALTERNATIVE PROCEDURES, ANY DISPUTE AND/OR DIFFICULTY CONCERNING THE INTERPRETATION OR EXECUTION OF THESE GENERAL TERMS AND CONDITIONS OF USE SHALL FALL WITHIN THE JURISDICTION OF THE FRENCH COURTS.
